WHY A CONDITIONAL USE PERMIT IS NECESSARY

A recent series of articles have been published concerning the need for a conditional use permit by at a certain location in Wildomar. This group of individuals have made the claim they should be exempt from or granted a discount for this permit claiming they are a home based business, they have claimed they are keeping the area rural in keeping with the wishes of the citizens of Wildomar, etc. They have appealed to the public with claims they are helping disadvantaged children, they have the Mayor of Wildomar’s support for their endeavor, etc.
This is far from being a home-based business.
First and foremost this is a horse rescue facility, more to follow on that subject below. Looking at their website “Oak Meadows Ranch's goal will be to have available a western themed ghost town setting complete with bunk beds and an Native American Camp complete with Teepees.”Per their website. The claim is these buildings are 8 X 8 and 8 X 12 and therefore exempt The code allows exemptions for (1. One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 120 square feet (11 m2). Looking at the picture (I would post it here but the only way I have been able to access their website is through a proxy server since the first negative comment I made about this group) and reading their website shows a different story. They currently host a mechanical bull to entice visitors to the facility for their Sunday Potlucks. The also wish to host birthday parties, night horse camp and retreats, corporate retreats, weddings, etc.
They have made the claim they are a Home based business?   Home based businesses include those which are secondary and incidental to the use of a home as a residence and do not: dispense goods from the home; do not employ other than the resident family members; do not generate noise, activity, traffic, odor, dust or have outside storage or accessory buildings to conduct the business. Currently these are exempt from fees.
As to the horse rescue facility, all donations made to enjoy access to this ranch are made to the Blue Pearl Project a non profit corporation incorporated in Cheyenne, Wyoming. They claim to be capable of housing 105 horses which will generate manure. Total stall waste produced averages between 60 and 70 pounds per day, which amounts to approximately 12 tons of stall waste per year per animal. Per (Virginia Cooperative Extension) http://pubs.ext.vt.edu/406/406-208/406-208_pdf.pdf.  This amounts to 2,520,000 pounds of manure annually at capacity. Internal parasites, insects, rodents, and odors can be manure related health concerns on horse farms not to mention flies, Flies breed when temperatures rise above 65̊F (The average temperature of Wildomar is 65.39̊F, which is higher than the California average temperature of 61.17̊F and is much higher than the national average temperature of 54.45̊F.) http://www.usa.com/wildomar-ca-weather.htm  .
This along with the potential for run-off if not managed properly, manure can deposit excess nutrients into the environment via surface runoff or as leachate (water contaminated with manure) from improper manure storage and land application. This can negatively impact water quality which should be a concern on this property that is home to a blue line stream which they call a ditch. Livestock operations near and around streams may be regulated by communities. Livestock can significantly degrade the stream system with excess Nitrogen and Phosphorus (http://www.lsuagcenter.com/NR/rdonlyres/95991A02-73F1-4C22-8DEB-A439ED5710D0/61166/pub3128FManagingh... ). Looking at the County of Riverside GIS maps of this property show this stream starting 1200 feet north of the property traveling thru the property going under Bundy Canyon Road at the southern edge of the property joining the stream out of the Farm Community and traversing the center of Wildomar were it finally empties into the Murrieta Creek just west of Palomar/McVicar. Murrieta Creek is listed as an impaired creek for Iron, Manganese and Nitrogen and Phosphorus http://watersgeo.epa.gov/mywaterway/   (These are waters that are too polluted or otherwise degraded to meet the water quality standards set by states) per EPA 303(d) list.
Along with the concerns about non rural residential construction they wish to perform on this property is the concern about increased traffic turning off of Bundy Canyon Rd. on what is currently a dirt drive less than a mile from the Farm Community. Bundy Canyon Rd. in the past has been referred to a “Blood Alley” by local residents. 
The city has a legal obligation to request a Conditional Use Permit for this facility at the full price that any other business would be required to pay for the same permit. Wildomar Municipal Code Title 17 Zoning Chapter 17.200.050 Conditions.A conditional use permit shall not be granted unless the applicant demonstrates that the proposed use will not be detrimental to the health, safety or general welfare of the community. Any permit that is granted shall be subject to such conditions as shall be necessary to protect the health, safety or general welfare of the community. (Ord. 18 § 2, 2008, RCC § 17.200.050)
